Warner/Chappell apologizes to pearLyrics

"Lawsuit first, ask questions later" strategy backfires; but pearLyrics not back yet.

iTunes already lets you add copious and useful metadata to your music collection, but when version 6 came out, the good developers at Apple added a way to store lyrics along with each tune. What a handy feature!

But what's not so handy is typing in all those lyrics by hand. So, a quick Google against some lyrics web sites, a little cut-and-paste, and then you've got the lyrics safely stored along with your own legally purchased music. But why not go one step further and automate that process? Help reduce the growing epidemic of carpal tunnel syndrome!

And that's what Walter Ritter thought; this Austrian hobbyist developed pearLyrics, a program (for Mac OS X only, but that's OK by me) for iTunes that automatically searches web sites for lyrics and copies them into your iTunes metadata. Essentially, it's an automated web browser, doing in one click what would take a lot more, using information that's already out there.

But Warner/Chappell thought differently. Was it music should be heard, but not understood? Regardless, they sent a cease-and-disist order to Mr Ritter: "if you distribute pearLyrics, we'll sue your ass off," essentially.

Now, pearLyrics contains no intellectual property of Warner/Chappell. It contains no copyrighted lyrics itself. It's just an automatic web browser. But Warner/Chappell followed the fashion of so many other record companies: sue first, ask questions later. pearLyrics disappeared off the public Internet (and surely into the private netherealms of P2P), as Mr Ritter did not have the time, money, or inclination to face a lawsuit to defend what was perfectly legal software.

Thanks to an open letter sent by one of EFF's finest, Fred von Lohmann, Warner/Chappell has apologized to Walter Ritter.

Now, pearLyrics still isn't back online. And the wording of the Warner/Chappell apology leaves a bit to be desired. But I certainly hope that Mr Ritter will return his application to the web soon, and that other developers of clever, useful, and unique applications won't be chilled by this action.
